"Where Are We Today?" TOP
- The Dallas Morning News says - ”I’m still looking. I will keep you updated. I have been swamped recently with other stories, but you are still on my list.”
- HB 1212 was passed in the House, Senate and signed by Governor Rick Perry. Why is this bill important to our son’s case? Why is this bill important to you?
- We have responded to several posts on the Bedford Topix website. So has an individual who claims to be a member of the Medlin family. Topix Story
Brief Overview TOP
For our new readers, a brief overview - Roy Jr. was convicted in August 2005 of intoxication manslaughter in the June 12, 2004 death of Grapevine Police Officer Darren Medlin based on an analysis provided by the Tarrant County Medical Examiner’s lab. (INTOXICATION MANSLAUGHTER)
Our son and our family have extended sincere condolences and will always have tremendous sorrow in our hearts for the Medlin family in the loss of their son. Without diminishing our sorrow, our condolences in any way, we very much believe our son is wrongfully convicted and incarcerated. We do not believe he was intoxicated or impaired. After the accident, a Dallas neurologist
specializing in epilepsy treatment diagnosed our son with epilepsy and testified he believed the accident was caused by an epilepsy seizsure.
(WE NEVER BELIEVED OUR SON WAS INTOXICATED)
We choose to question decisions made and actions taken by the Prosecuting Attorney, Euless Police Department Officer Ramsour, Tarrant County Medical Examiner’s Office and the TX 2nd District Court of Appeals, especially these:
- Euless Police Officer Ramsour testified that she turned off her in-car videotape camera before exiting her vehicle when she approached our son to explain why the tape ended at that point. (PRE-TRIAL AND TRIAL DISCREPANCIES)
- The Tarrant County Lead Prosecutor’s office changed the regular handling process for our son’s blood draw. He directed the blood draw to go to the Tarrant County Medical Examiner’s lab rather than the normal process of having it go to a state lab. (PRE-TRIAL AND TRIAL DISCREPANCIES)
- The Tarrant County Medical Examiner (POST TRIAL REVELATIONS) testified there were “small, small” things that needed to be changed in the lab to meet certification requirements. We learned after the trial that the lab was not in compliance with 11 essential requirements. Not meeting one (1) essential requirement means the lab cannot be certified. This lab analyzed our son’s blood draw that resulted in a 0.11 blood alcohol content.
- The TX 2nd Court of Appeals (2ND DISTRICT COURT OF APPEALS INCONSISTENCIES) denied my son’s appeal. In their denial, they mentioned that “major deficiencies” in the lab were exposed in trial testimony. We learned this after the trial. The original judge did not hear this information and neither did the jury. If he had, we understand he would have not been able to accept evidence (.11 BAC) from the lab. Since the TX 2nd Court of Appeals had this information, how could they accept evidence from the lab. How could they deny the appeal?
- Roy Jr. has been transferred to the Roach Unit in Childress, Texas. We visit him regularly. He has a wonderful spirit and strong faith in God.
- Our son’s case is now at the Texas Court of Criminal Appeals in Austin. Our attorneys have indicated they do not have a timeframe on when this Court will act.
- Listen to these radio shows and go to michaelbaisden.com, rickeysmiley.com and blackamericaweb.com to add your thoughts, comments about Roy Jr.'s case and Choose2question.com campaign and website.
- Provide feedback to Jim Witt of the Ft. Worth Star Telegram. Let him know if you think his paper’s actions around this case is reflective of a credible newspaper: jwitt@star-telegram.com.
- Contact your TX Senators and Representatives and ask them about their position on TX HB 1212. Tell them it matters to you that so many brown and black males are in the Texas prison system industry. Ask them what they plan to do about it.
- Continue to pray for our son and all the others imprisoned (wrongfully or not). If you know someone in jail, send them a letter or card to show you care they are a human being and not a commodity.
- Vote and serve on juries.
